Nothing in these Terms is intended to exclude, restrict or limit any rights or remedies that cannot lawfully be excluded under applicable South African law.

Products must be installed, operated, maintained and used in accordance with applicable safety requirements and manufacturer instructions.

Nothing in this section limits any statutory rights or obligations that cannot lawfully be excluded.

6. Pricing

All prices displayed on our South African online store are stated in South African Rand (ZAR) unless otherwise indicated.

Where stated or applicable, prices include Value Added Tax (VAT).

Delivery, courier or other applicable charges may be added at checkout and will be displayed before the customer completes the transaction.

We make reasonable efforts to ensure pricing is accurate. However, genuine pricing, typographical or system errors may occasionally occur.

Where we identify an obvious pricing error before fulfilling an order, we may contact you to advise you of the error and give you the opportunity to proceed at the correct price or cancel the affected item or order for a full refund.

Nothing in this clause permits us to engage in misleading pricing practices or limits any rights available under applicable law.

7. Quotations

Unless otherwise stated in writing, quotations are subject to product availability and remain valid only for the period specified on the quotation.

Prices may change after the validity period has expired.

A quotation does not guarantee that stock will remain available unless specifically agreed otherwise in writing.

8. Orders

Submitting an order through our website constitutes an offer to purchase the selected products.

After an order is placed, you may receive an automated confirmation acknowledging receipt of the order.

An automated acknowledgement does not necessarily mean that we have accepted the order.

We reserve the right, where reasonably necessary, to decline or cancel an order before fulfilment, including where:

  • A product is unavailable;
  • An obvious pricing or product-information error has occurred;
  • Payment cannot be authorised or verified;
  • We reasonably suspect fraud or unauthorised activity;
  • Delivery cannot reasonably be completed to the supplied address; or
  • Fulfilling the order would be unlawful.

If we cancel an order after receiving payment, we will refund amounts paid for the cancelled goods in accordance with applicable law.

9. Product Availability

All products are subject to availability.

Although we make reasonable efforts to keep online stock information accurate, stock quantities may occasionally differ from actual availability due to simultaneous sales, supplier availability, inventory adjustments or system delays.

If an ordered product becomes unavailable, we will contact you and may offer:

  • A suitable alternative;
  • A revised expected availability date; or
  • A refund for the unavailable item.

We will not substitute a materially different product without the customer's agreement.

10. Payment

Payment must be made using one of the payment methods made available at checkout or otherwise agreed with Alrode.

Orders may not be dispatched until payment has been successfully received or authorised, except where the customer has an approved credit account with Alrode and the purchase is made in accordance with the agreed credit terms.

Online payments may be processed by third-party payment service providers and may be subject to their applicable terms and security procedures.

11. Account Customers

Customers with approved Alrode credit accounts remain subject to their separately agreed account and credit terms.

Where there is a conflict between these Terms and specifically agreed written credit or account terms, the specifically agreed terms will apply to the extent of that conflict, subject to applicable law.

Failure to comply with agreed payment terms may result in the suspension or withdrawal of credit facilities.

12. Delivery and Collection

Delivery options, charges, free-delivery promotions, delivery areas, weight restrictions and other delivery conditions are governed by our Shipping Policy.

Delivery estimates are estimates unless expressly agreed otherwise.

Customers are responsible for providing complete and accurate delivery information.

Where permitted by law, additional costs arising from an incorrect or incomplete delivery address supplied by the customer may be charged to the customer.

Customers selecting collection will be notified when their order is ready for collection.

Please do not travel to collect an order until you have received confirmation that it is ready.

13. Free-Delivery Promotions

From time to time, Alrode may offer free or discounted delivery subject to minimum order values, weight limits, geographic restrictions, selected delivery methods or other qualifying conditions.

The current qualifying conditions will be set out in our Shipping Policy or displayed as part of the applicable promotion.

Exceptionally bulky, oversized or heavy products may be excluded from certain free-delivery promotions where stated in the Shipping Policy or applicable promotional terms.

14. Returns, Refunds and Defective Goods

Returns, refunds, exchanges and defective goods are dealt with in accordance with our Refund & Returns Policy and applicable South African law.

Our commercial return rules do not exclude or restrict statutory rights that cannot lawfully be excluded.

Customers should notify us as soon as reasonably possible if goods are damaged, defective, incorrectly supplied or incomplete.

15. Special Orders and Custom Products

Certain products may be specifically sourced, ordered, manufactured, cut, altered or otherwise prepared to meet a customer's requirements.

Customers are responsible for checking specifications and quantities before confirming special or customised orders.

Special-order or customised goods may be subject to different cancellation and return conditions, as described in our Refund & Returns Policy and permitted by applicable law.

Where reasonably appropriate, these conditions may also be communicated before the order is confirmed.

16. Sale and Clearance Products

Sale and clearance products may be subject to limited availability and may not qualify for discretionary change-of-mind returns.

This does not exclude any statutory right or remedy that applies to defective, unsafe, incorrectly supplied or otherwise non-compliant goods.

17. Cancellation and Cooling-Off Rights

Certain electronic transactions may qualify for a statutory cooling-off period under the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

Where the statutory cooling-off right applies, it will be honoured in accordance with ECTA.

Certain goods and transactions may be excluded from the statutory cooling-off provisions, including categories specified by ECTA.

18. Warranties

Products may carry warranties provided by their manufacturers or suppliers.

Where a manufacturer or supplier warranty applies, we may assist customers with the applicable warranty process.

Manufacturer warranties are subject to their own terms and conditions but do not replace or reduce statutory rights that a customer may have under applicable South African law.

Damage caused by misuse, abuse, unauthorised modification, incorrect installation, failure to follow manufacturer instructions or normal wear and tear may not constitute a product defect, subject to applicable law.

19. Consumer Protection

Where applicable, transactions with Alrode are subject to the Consumer Protection Act 68 of 2008 (CPA), ECTA and other applicable South African consumer legislation.

The extent to which particular provisions apply may depend on the nature of the customer and transaction.

Nothing in these Terms is intended to waive, exclude or restrict rights that cannot lawfully be waived, excluded or restricted.

20. Business Customers

Alrode supplies both individual consumers and businesses.

Certain provisions of South African consumer-protection legislation may apply differently depending on whether the purchaser is a natural person or juristic person and, where relevant, whether statutory thresholds or exclusions apply.

Where statutory consumer protections do not apply, the transaction will be governed by these Terms and any separately agreed written terms between Alrode and the customer.

21. Intellectual Property

Unless otherwise stated, the content of this website, including Alrode branding, text, graphics, page layouts and original website content, belongs to Alrode or is used with permission.

Product names, trademarks, logos and images belonging to manufacturers, suppliers or other third parties remain the property of their respective owners.

Website content may not be copied, reproduced, republished or commercially exploited without the permission of the applicable rights holder, except where permitted by law.

22. Third-Party Services and Links

Our website may contain links to or integrations with third-party services, including payment, delivery, analytics or other service providers.

We are not responsible for the content or independent practices of third-party websites or services that we do not control.

26. Force Majeure and Events Beyond Our Control

We will not be responsible for a delay or failure to perform an obligation where performance is prevented or materially affected by circumstances reasonably beyond our control, subject to applicable law.

Such circumstances may include severe weather, natural disasters, fire, flooding, industrial action, civil disturbance, widespread infrastructure failures, transport disruption, government action or significant telecommunications or electricity failures.

We will take reasonable steps to minimise the effect of such events where practicable.

27. Errors and Omissions
